The client was a 23-year-old resident of Riverdale, Georgia with no prior criminal history. He legally purchased the 38 special handgun in Georgia and was found in Readington, New Jersey with the handgun on his person in a motor vehicle without any permit to carry or possess the weapon here. Thus, he was charged with 2nd degree unlawful possession of a weapon in violation of N.J.S. 2C:39-5b. In addition, he had hollow point bullets which are illegal in New Jersey but not in Georgia. This is a fourth degree felony charge in violation of N.J.S. 2C:39-3f.

The typical plea offer on these cases, even for a defendant with no prior record, is five (5) years in prison, 42 months to be served without the possibility of parole. In order to avoid this, the State must agree to a Graves Act waiver and the Judge must approve it. Here, we submitted a package to the prosecutor showing that the client was in New Jersey on business, working on cell phone towers for his company. We also provided proof of purchase for the weapon in Georgia and a host of character letters from friends, family, co-workers, and other members of the community who have known the defendant for many years. Based on this written submission and our persuasive arguments to the prosecutor, they agreed to offer admission into the Pre-Trial Intervention program (known as “PTI”). The client had to plead guilty to the 2nd degree possession of a handgun without a legal permit. He was placed into the PTI program for a period of twelve (12) months. Upon his successful completion of the PTI probation, the charges will be completely dismissed.
