Arrested with my out of State gun in New Jersey

We have represented many clients over the years who were arrested with their legally purchased gun from their home state in New Jersey. Unfortunately, New Jersey and New York have the most strict gun laws in the United States. So, just because it is legal for you to have your gun in the State you live in does not mean it is legal for you to have it here in New Jersey. You are allowed to transport the weapon through NJ but only in a very specific way. If you are driving through NJ you must have the gun in a locked gun case in the trunk of your vehicle, unloaded, and separate from the ammunition. Otherwise, you are illegally transporting the gun in NJ and can be arrested for it.

If you are arrested with your gun in NJ and you are from another state, you will typically be charged with 2nd degree unlawful possession of a weapon. This is a very serious felony offense which is punishable by 5-10 years in prison and there is a presumption of jail time even for first time offenders. In addition, because of these serious NJ gun laws, under the Graves Act, you are facing a mandatory period of jail time and parole ineligibility. The typical plea offer we see, even for first time offenders, is 5 years in prison, 42 months to be served before the possibility of parole.

If the gun was legally purchased in your home state and you have a permit for it there (if you need one), there is a good chance that you can avoid jail time and even this felony charge on your record. There is a first time offender program called Pre-Trial Intervention (known as “PTI”) which allows a defendant to be placed on probation and, if they successfully complete the probation and comply with the conditions, the charges are dismissed at the end of the probationary period.

The defense lawyer can submit a compelling reasons package in support of a Graves Act waiver and PTI application which typically includes the following:

Proof of legal purchase of the weapon (receipt)
Gun permit from home state
Proof of employment, employment records
Travel documents (why the defendant was traveling to NJ or through NJ)
Character references

The assistant prosecutor assigned to the case will then review the package and speak to their supervisors about a potential plea offer. On a 2nd degree charge, the defendant can’t even apply for PTI unless the prosecutor consents. Once they consent, probation will interview the defendant and make a recommendation to the court and the prosecutors office about whether or not they think the defendant is a good candidate for PTI. However, the prosecutor makes the ultimate decision.

If you applied for a gun permit in Warren County and you were denied, you have the right to appeal. The appeal must be filed in writing within 30 days of your denial. It must be submitted in writing to the Warren County Prosecutor’s office, the NJ superintendent of state police, and the chief of police in the town where you live. Then, a gun permit appeal hearing will be scheduled in the Warren County Superior Court within 30 days of your appeal being filed. Guns Seized Based on Domestic Violence Restraining Order Warren County NJ

If a temporary restraining order (TRO) was filed against you, your weapons must be seized under NJ law. Then, if a final restraining order is issued in court, you are prohibited from owning or possessing weapons permanently. You may be able to have the weapons transferred to a family member or to a gun dealer to be sold. However, if the temporary restraining order is dismissed, your weapons can be returned to you but this doesn’t happen automatically. The Warren County Prosecutors office has 45 days to decide whether they will return the guns to you or file a forfeiture action. If they file for forfeiture, a hearing will be scheduled in the Warren County Court for a Judge to decide if your weapons should be returned to you or forfeited.
