Moreover, the typical offer on illegal gun possession cases in New Jersey, even with someone with no prior criminal history, is 5 years in prison, 3 years to be served without the possibility of parole. As a result, this was an extremely serious charge with dire consequences for our client if she was convicted of this offense.

The facts of the case are as follows: Our client, a young Texas woman with no prior record and a great job, was helping her friend move from Texas to New York state. They were driving up together and our client’s father, a Texas resident as well, insisted that his daughter bring her firearm for protection since two young women driving long distances like that late at night could put them in danger. She agreed and the gun was in the glove compartment of the vehicle when they were stopped by police for a minor traffic violation. Unfortunately, if you have a valid permit in Texas it does not mean you have a valid permit in New Jersey. In addition, if they were trying to legally transport the weapon with them to their new destination in New York, it should have been in a locked gun case in the trunk of the vehicle and must be stowed separate from any ammunition for the weapon. None of these requirements were complied with in this case.

Based on our client’s exemplary record, her employment, and a host of character letters we provided to the assistant prosecutor in Bergen County, our client applied and was accepted into the Pre-Trial Intervention program (known as “PTI”). This allowed the charges to be suspended during a probationary period and, upon her successful completion of that probation, the case is dismissed. This allows the client to not only remain out of jail but also to avoid a felony conviction on her record. Six months after she completes the PTI program she is eligible to expunge the arrest. After that happens, the entire incident is removed from her record.
